En Virginia, la captación en línea de un menor entra dentro de un código legal estatal denominado «Uso de sistemas de comunicaciones para facilitar ciertos delitos que afectan a menores».
El código declara ilegal el uso de un sistema de comunicaciones, incluidos Internet, teléfonos móviles u otros medios electrónicos, para intentar mantener ciertos tipos de actividad sexual con un menor. Las actividades específicas que están prohibidas en virtud de esta sección del código son el uso de un sistema de comunicación con el fin de captar con intención lasciva, que un menor haga a sabiendas e intencionadamente cualquiera de las siguientes cosas:

¿Cuáles Son Las Penas Por Captar Menores Por Internet?
Los cargos varían en función de la edad del menor y del presunto delincuente. Sin embargo, el código declara ilegal que cualquier persona, independientemente de su edad, utilice un sistema de comunicaciones para captar a un menor con estos fines sexuales.
Si el menor tiene al menos quince años pero menos de dieciocho y el presunto delincuente no es más de siete años mayor que la víctima, el delito es un delito grave de clase 6 que se castiga con hasta cinco años de prisión o hasta doce meses de cárcel y/o una multa de 2.500 dólares. Sin embargo, si el presunto delincuente es al menos siete o más años mayor que el menor, el delito es un delito grave de clase 5, castigado con una pena de uno a diez años de prisión o hasta doce meses de cárcel y/o una multa de 2.500 dólares. Un segundo delito en el que el delincuente sea siete o más años mayor que la víctima se castiga con una pena de uno a veinte años de prisión, un año de los cuales es una condena mínima obligatoria que debe cumplirse en su totalidad.
La segunda categoría de estos delitos son aquellos en los que el menor tiene menos de quince años. Si el menor tiene menos de quince años y el presunto delincuente adulto no es más de siete años mayor que la víctima, el delito es de clase 5. Si el menor tiene menos de quince años y el presunto delincuente adulto es al menos siete o más años mayor que la víctima, el delito se castiga con penas de cinco a treinta años de prisión, cinco de los cuales son una condena mínima obligatoria que debe cumplirse en su totalidad. Un segundo delito en el que el menor tenga menos de quince años y el presunto delincuente adulto sea al menos siete años mayor que el menor se castiga con penas de diez a cuarenta años de prisión, diez de los cuales son obligatorios y deben cumplirse en su totalidad.
Además, la incitación en línea abarca los casos en que un adulto utiliza Internet u otro sistema de comunicaciones para solicitar a alguien que tiene razones para creer que es menor de 18 años que participe en pornografía infantil de cualquier forma. Estos delitos se consideran delitos graves de clase 5.
