En Virginia, se considera agresión sexual cuando un acusado toca las «partes íntimas» de otra persona o material que cubra directamente dichas partes íntimas por la fuerza, amenaza, intimidación o artimaña, contra la voluntad de la otra persona y con la intención de molestar, excitar o gratificar. La agresión sexual también puede producirse cuando un agresor obliga a otra persona a tocar las partes íntimas del agresor con el mismo fin.
Agresión Sexual Con Agravantes En Virginia
Además de la agresión sexual, también existe lo que se considera agresión sexual con agravantes. Según el Código de Virginia §18.2-67.3, hay casos en los que la agresión sexual puede considerarse «agravada», y convertirse en un cargo de delito más grave.
Un cargo de agresión sexual agravada incluye todos los elementos de la agresión sexual simple, más una de estas alegaciones:
- Abuso sexual de un menor de 13 años
- Abuso sexual de una persona con discapacidad mental o física
- Abuso sexual de un adolescente por parte de sus padres, abuelos o abuelastros
- Abuso sexual con uso de fuerza, amenaza o intimidación cuando la víctima tiene 13 o 14 años, el acusado causa lesiones corporales o mentales graves a la víctima o el acusado utilizó o amenazó con utilizar un arma peligrosa.
Una condena por agresión sexual con agravantes puede conllevar una pena de prisión de 1 a 20 años y una multa máxima de 100.000 dólares.
Agresión Sexual Con Agravantes Cuando Está Infectado
La agresión sexual con agravantes también puede incluir escenarios en los que una persona intenta intencionadamente infectar a otra con ciertas enfermedades de transmisión sexual.
El delito se produce cuando una persona:
- Está infectado por VIH, sífilis o hepatitis B
- Lo sabe
- Y tiene contacto sexual con otra persona con la intención de transmitir la infección
La pena, si se le declara culpable de un delito grave de agresión sexual infectada, puede incluir de uno a cinco años de prisión y una multa máxima de 2.500 dólares.
Si la persona conocía su infección, no tenía intención de transmitirla a la otra persona pero tampoco se la reveló, podría ser condenada por un delito menor de agresión sexual infectada, castigado con hasta 12 meses de cárcel y una multa de 2.500 dólares.
Penas Para Reincidentes En Virginia
Si tiene dos condenas previas en los últimos 10 años por agresión sexual o intento de agresión sexual, se le acusará de un delito grave. Las condenas por relaciones sexuales consentidas con un menor o exhibicionismo también contarán para hacer de la condena actual un tercer delito a efectos de la ley. Tercer delito de agresión sexual = de 1 a 5 años o hasta 12 meses de cárcel y una multa de 2.500 dólares.
En algunas circunstancias, el §18.2-67.5:2 del Código de Virginia exige la pena máxima autorizada por la ley cuando se es declarado culpable de agresión sexual con agravantes. La ley no permite la suspensión de ninguna parte de la condena. Esto ocurre si tiene una condena previa por agresión sexual con agravantes u otro delito grave de agresión sexual.
