Por ejemplo, si poseyera 100 imágenes, podrían acusarle de 1 primer delito y 99 segundos delitos.
Cualquier persona que distribuya pornografía infantil se enfrenta a un cargo de delito grave no clasificado, tanto si vendió el material como si lo regaló. La condena por este cargo conlleva una pena de un mínimo de cinco años en un correccional estatal y un máximo de 20 años. Un segundo delito de distribución conlleva una condena mínima obligatoria de 5 años en el intervalo de 5-20.
Además, toda persona que explote un sitio web de Internet con el fin de recibir un pago por acceder a pornografía infantil es culpable de un delito grave de clase 4. Esto conlleva una pena de entre dos y diez años de prisión y una multa máxima de 100.000 dólares.
